GENERAL TERMS AND CONDITIONS OF SALE (GTC)

These General Terms and Conditions of Sale (hereinafter "GTC") govern the sales of products concluded through the website accessible at the address www.edubark.com (hereinafter "the Site"), operated by:

ARTICLE 1 – PURPOSE AND SCOPE OF APPLICATION

These General Terms and Conditions define the rights and obligations of the parties in the context of the online sale of products offered by EduBark to its customers (hereinafter "the Customer").

Any order placed via the Site implies full and complete acceptance of these General Terms and Conditions by the Customer.

The Terms and Conditions are accessible at any time on the Site. EduBark reserves the right to modify them at any time. The applicable Terms and Conditions are those in effect on the date of the order.


ARTICLE 2 – PRODUCT INFORMATION

The products offered for sale are described as accurately as possible. However, errors or omissions may occur. Photographs have no contractual value.

EduBark reserves the right to modify the assortment of products offered on the Site at any time.


ARTICLE 3 – PRICE

Product prices are listed in local currency (CAD or EUR), excluding taxes and shipping costs. The total amount owed by the Customer is indicated before final confirmation of the order.

No VAT is charged at this time. The Customer is responsible for paying any applicable taxes or duties in their country of residence.

EduBark reserves the right to change its prices at any time. The applicable price is the one in effect at the time of the order.


ARTICLE 4 – ORDER

The Customer can place an order by selecting the desired products and following the steps indicated on the Site. Once the order is validated, a confirmation email will be sent to the Customer.

EduBark reserves the right to refuse any order in the event of an existing dispute with the Customer, total or partial non-payment of a previous order or for any other legitimate reason.


ARTICLE 5 – PAYMENT

Payment for purchases is made by credit card or any other payment method offered on the Site. All transactions are secure. The order is deemed accepted once payment has been validated.


ARTICLE 6 – DELIVERY

Products are delivered to the address indicated by the Customer when ordering. Delivery times are given for information purposes only and vary depending on the destination country.

EduBark cannot be held responsible for any delay in delivery attributable to the carrier or to a case of force majeure.

The transfer of risks takes place at the time the package is handed over to the Customer.


ARTICLE 7 – RIGHT OF WITHDRAWAL (EU Customers)

In accordance with European Directive 2011/83/EU, customers located in the European Union have 14 days from receipt of the product to exercise their right of withdrawal, without having to provide a reason for their decision.

To exercise this right, the Customer must notify EduBark of its decision by email to contact@edubark.com . The product must be returned at the Customer's expense, in perfect condition, unused, in its original packaging and with all accessories.

No refund will be made if the returned product is incomplete, damaged or used.


ARTICLE 8 – LEGAL GUARANTEES (EU Customers)

In accordance with Directive 1999/44/EC, products sold to consumers in the European Union benefit from a legal guarantee of conformity of 2 years from delivery, and a guarantee against hidden defects.

In the event of a defect, the Customer may request repair, replacement or, failing that, reimbursement of the non-compliant product.


ARTICLE 9 – COMMERCIAL GUARANTEE

Regardless of legal warranties, EduBark offers a 30-day money-back guarantee. This guarantee applies to products returned unused, in their original packaging, within 30 days of receipt.

All returns must be previously authorized by contacting customer service by email at contact@edubark.com .


ARTICLE 10 – LIABILITY

EduBark cannot be held liable in the event of improper use of the products by the Customer, nor in the event of force majeure.

EduBark cannot be held responsible for indirect damages that may arise from the purchase or use of the products.


ARTICLE 11 – PERSONAL DATA

EduBark collects and processes Customers' personal data in compliance with applicable legislation. For more information, please see our Privacy Policy.


ARTICLE 12 – APPLICABLE LAW AND DISPUTES

These T&Cs are governed by the laws in force in Quebec, Canada.

However, for consumers in the European Union, the mandatory consumer protection provisions provided for by the law of their country of residence remain applicable.

In the event of a dispute, the parties will seek an amicable solution. Failing this, the dispute will be brought before the competent court of the European consumer's place of residence or the jurisdiction of the Court of Quebec, as the case may be.


ARTICLE 13 – ARCHIVING OF THE CONTRACT

Contractual data will be archived on a reliable and durable medium that can be produced as proof.
